"but how would people make money?" you ask.. well, social media already answer that. you produce something and share online, if you're popular enought people are going to sponsor you. wich also open doors for more creative oriented works of art. half people in evey comment section have a profile picture of something they didn't do or pay for, wich IS piracy.

To Tom Scott: Excellent video. How about theory inventors? They can't legally patent, although there is no logical reason why they couldn't, and it is generally assumed they can only give away their inventions. If you're suggesting improvements to the system, remember theorists have always been barred from the system. They should be able to profit from their creations too. (I've independently invented a unifying theory which will easily replace all professionally used physics theories, and I am seeking a funding partner. If theorists were allowed to patent, schools would already be teaching my theory, and everyone worldwide would already be benefitting from it. Search keywords: matter theory marostica.)

Lets be honest, if a third party can claim ownership of something that does not belong to them because they paid to have a bot copyright claim bomb videos than something is very, very wrong. The owners of content should have to manually make the claims. From THERE we can talk about how broken the copyright system is in the rest of the world, but right now the copyright system of the world doesn't actually apply to youtube. Nowhere else can people have legal action brought against them by an automated system with no legal connection to its claims.

30. Melvin
9 klukkustundum síðan

Quick question though... How do you let these copyright bots know you have a license? For example, how does the ISpulse Copyright ID (I think it's called that right?) know that you have a license or that you used the material fairly?

I have a question that might've been answered in the video, I just wasn't paying attention at that second or forgot. Or it's common sense. But it seems that your points all seem to be around money. Earning revenue from using this content. What if I did so without earning revenue? A small channel starting out and I don't actually make money off of the content, it's just their? Would it still fall under fair use to due the lack of gain, or could they still may a copyright claim?

1. Commodus
12 klukkustundum síðan

Though the financial aspect is key, not making a profit from it is not a right to use it. It simply makes the companies involved less likely to go after you for it, but considering game companies going after fan projects, that's not a clear cut right even still. If you aren't making money from the use of music you don't own, you're still infringing the copyright and your video can be attacked for it. If it is not in any way a transformative use and you're simply using it to use it, don't expect any leniency should you get in trouble over it. There is ambiguity and the problem can become far more tricky, but not for your example.

- 4:46 while true, the copyright system can't always distinguish between different recordings of same public domain work. - 17:16 not so wide, if you happen to upload game footage at day 0 of the launch you will get copyright claims. Also companies like Konami and Nintendo abuse their copyright rights to claim everything their own. - 36:00 There is big issue about the public domain, big studios like Disney find a way to change the law in their benefits, or public domain of a movies when the characters turn into iconic only know to appear as they are in that particular movie, so nobody can't make a movie from the book for the Frankenstein, because the look of the character is copyrighted. The law is shaped to match the interest of the big companies.

I would suggest one more change: Licenses should be priced relative to the expected target audience size. The smaller the creator's audience is, the smaller fee they would need to pay to properly license the copyrighted content. This is the biggest hurdle right now for people who want to use that content legitimately. Thankfully, I have seen some companies doing this, such as lickd, which was designed specifically with youtubers in mind. Hopefully more companies join this mindset, and hopefully the law gets modified to make this a requirement. Honestly, I'd argue that if an audience is small enough, there shouldn't be a fee.

I think that one of the problems is that the US and UK both use intentionally vague language in their statutes, meaning that contracts must be long and complex, as the English Common Law legal system allows for statutes to be overturned or altered by judges. What they COULD do is move over to the Roman Civil Law system that’s used in Continental Europe and have highly detailed language in the statute, with simpler contracts. The downside, however, is that the “innocent until proven guilty” standard in criminal cases gets flip-flopped, so doing this would uproot one of the US’s core national values.

Not fundamentally broken? I've had hundreds of copyright claims for videos with SILENT soundtracks. How can there be a match between any music at all and complete silence? This is obviously not possible so yea the system is definitely fundamentally broken.

1. Commodus
12 klukkustundum síðan

The intent that the approach is trying to solve is the problem behind what ISpulse is doing. If you could work that sentence, that is the key. They aren't doing it for no reason. The problem, however, is how they're going about it in addition to what they're trying to accommodate, and there you have a rather sticky mess.

2. David Hembrow
David Hembrow
22 klukkustundum síðan

And by silent I really do mean silent. I.e. every single sample in the soundtrack has the same value. There is nothing to be heard. Yet every week there are new claims against these old videos.
